Using this site, and buying from us.

These are CMD’s standard terms, in plain words. Part A covers the website. Part B covers buying Whitmore products from us.


01Scope

What these terms cover.

Part A covers using this website. Part B covers buying Whitmore products from CMD Consulting Pty Ltd.

Using the site means you accept Part A. Placing an order means you accept Part B.

If we change these terms, section 14 says how.


02Ownership

Whose content this is.

The content on this site belongs to CMD Consulting Pty Ltd, or is used with permission.

Whitmore® is a registered trademark of Whitmore Manufacturing, LLC. We use it to describe genuine Whitmore products that we supply.

You may read, print and share pages for your own work. Ask us first before copying them into other publications.

Do not misuse the site, probe it, or disrupt it.


03Guidance

Technical content is guidance.

Articles, figures and calculators here are engineering guidance, not project-specific engineering advice.

Product figures are from the Whitmore document set of 2 June 2026. Confirm against the current Whitmore TDS at quote.

The girth-gear sizing calculator carries its own disclaimer on its page. That disclaimer governs the tool.

Some links here lead to other companies’ websites, including Whitmore’s.

Those sites are not ours. Their content can change without our knowledge.


05The site

What we answer for here.

We keep this site accurate and current, but we do not promise it is free of errors.

So far as the law allows, we accept no liability for loss from relying on the site alone.

Nothing in these terms excludes rights the Australian Consumer Law gives you.

What this site collects about you is covered by our privacy policy.


06Supply

When Part B applies.

Part B applies to quotations, orders and supply of Whitmore products by CMD Consulting Pty Ltd in Australia.

Each sale is governed by these terms and the quotation we issue.

If we sign a separate supply agreement with you, that agreement prevails.


07Orders

Quotations, and how orders form.

A quotation is valid for the period stated on it.

Your purchase order is an offer. A sale forms when we accept it in writing.

Due to the volatility of raw materials cost, prices quoted may change at any time without notice.


08Payment

Prices, GST and payment.

Prices are in Australian dollars unless the quotation says otherwise.

GST is added at the current rate where it applies.

Payment terms appear on the quotation. Unless it says otherwise, payment is by EFT before dispatch.


09Delivery

Delivery, and when risk passes.

The delivery basis and lead time are stated on the quotation.

Delivery dates are estimates. We will tell you promptly if one moves.

Risk in the goods passes to you on delivery.


10Title

Ownership until payment.

Goods remain the property of CMD Consulting Pty Ltd until paid for in full.

Until then, store them so they can be identified as ours.

We may register our interest in the goods under the Personal Property Securities Act 2009.


11Returns

Inspection, and returns.

Inspect the goods when they arrive. Tell us promptly about shortages, damage or wrong items.

Returns need our prior written agreement. Products ordered in specially, or specially packaged, cannot be returned.

Nothing in this section limits your rights under the Australian Consumer Law.


12Safety

Datasheets and safe handling.

We supply genuine Whitmore products, with their technical and safety datasheets.

Whether a product suits your application is your decision. We can help you make it.

Read the safety data sheet before use. Store and handle products as the datasheet directs.


13Warranties

Your guarantees, and our limits.

The Australian Consumer Law gives you guarantees that cannot be excluded.

Our warranty page explains those rights, the manufacturer’s warranty, and how to claim.

For goods not ordinarily bought for personal or household use, we limit our liability where the law allows. It is limited to replacing or resupplying the goods, or paying the cost of doing so.

Nothing here limits a liability that cannot lawfully be limited.


14General

The rest, in plain words.

The general clauses every set of terms needs, kept short.

We are not liable for delay caused by events outside our reasonable control.

If part of these terms cannot be enforced, the rest still stands.

These terms are governed by the law of Queensland, Australia. Queensland courts have jurisdiction.

If we change these terms, we will update this page and the date below. Changes do not apply backwards to orders already accepted.
